GENERAL CONDITIONS
The following terms and conditions shall apply to all Vitur events. In the event of a signed contract between Vitur (formally known as Vitur Tourism Solutions S.L.) and any other party, the provisions of the contract shall supersede these terms and conditions if any discrepancy arises.
These Terms and Conditions govern your online registration, attendance and/or participation in a Vitur Summit or event. By registering, you agree that you have read and accepted these Terms and Conditions and agree to abide by them. If you do not wish to be bound by these Terms, please do not register, attend or participate in any of our activities.
Object and purpose of these terms and conditions
Vitur Tourism Solutions S.L. (hereinafter "Vitur", "Vitur Tourism Solutions S.L.", "We" or "Us") is a company incorporated under the laws of Spain with company identification number B-42927426 and registered office in Malaga (Spain) at Paseo de Reding 9, 29016.
Vitur is a platform that brings together players in the short-term rental sector and tourism as a way to create opportunities. A meeting point for the most promising startups, the main international investors and companies committed to innovation. Vitur is a professional tool that fosters interaction and the creation of business opportunities: visibility, access to funding and strategic agreements for startups, innovation for corporations and deal flow for investors. It is, in short, a place where entrepreneurship, innovation and investment are a reality.
With the celebration of Vitur Tourism Solutions S.L., Vitur has become the main meeting point of the European entrepreneurial ecosystem.
Scope of conditions
Participation in Vitur's activities in any of the modalities foreseen in these conditions implies the acceptance of the terms and conditions expressly foreseen for this purpose and will be of a contractual nature between Vitur and the participants, speakers, attendees, volunteers or advertisers of any kind.
It is therefore an agreement between us and the person accessing our services through our web platform. It will consist of:
1. General terms and conditions for all participants; containing the terms applicable to all participants.
2. Terms for attendees, which contains specific terms for registered attendees attending an event ("...").Assistant", "you", "its");
3. Exhibitors' conditions, which contains the specific conditions for exhibitors attending the event ("...").Exhibitor", "you", "its"),
4. Participants in the startup competition.
5. Volunteer terms, which contains the terms applicable to volunteers participating in any area of the event ("...").Volunteer", "you", "its");
6. Access to and use of the website.
(collectively, the "Conditions").
Processing of personal data
We are committed to protecting your personal data. These Terms include and incorporate by reference our privacy policywhich explains all the information that may be collected, stored, processed electronically, shared with our network or third parties and processed in connection with our activities. It will also tell you how and why we use such information, with whom we share it and your legal rights. This will include your right to opt out of any use of the information.
You will be asked to acknowledge and fully accept this policy when you purchase a ticket to attend any activity, become a volunteer, exhibitor or participate in the startup competition.
These Conditions also include the terms and conditions of our website to the extent that you use our website or complete registration and purchase a ticket for any of our events or apply to be a volunteer, exhibitor or participate in the competition.

Registration on behalf of another
If you are registering on behalf of another person, it is your obligation to ensure that the person attending is aware of these Terms and Conditions and accepts them. By completing and submitting the registration form, you represent and warrant that you have made the person attending aware of these Terms and Conditions and that they have accepted them. They will be binding as if they had registered themselves.
Changes to this policy
These Terms apply from the date of publication and until these Terms are superseded by a new version. We may update these Terms at any time for legal or regulatory reasons, or to reflect changes to our services or business practices. You can find the date of the updated version above or below.
1. General conditions for all participants
Admission to events
We, in our sole discretion, and without any liability or obligation for reimbursement, reserve the right to refuse admission to or expel from the event any person we determine to be a "no show":
- Behaves in a manner likely to disrupt, hinder or cause a nuisance to the event or to the enjoyment of any other person or member of the event.
- It poses a risk to the safety or health of the event or to any person or partner.
- Breach or may breach these Conditions.
You agree to comply with all applicable laws in connection with your attendance or participation in an event.
Changes or cancellation of an event.
While we try to ensure that event programmes, speakers, topics and venues are correct at the time of publication, circumstances beyond our control may make it necessary to substitute, alter, postpone or cancel the content, format, topics, name, performers, hosts, moderators, venue or timing of an event.
We will endeavour to notify you as soon as reasonably possible of any substitution, postponement or change by posting updated information on our website.
In the unlikely event that an event is postponed or cancelled, our total liability to you is limited to the refund of any paid fees remaining after credit card and payment processing fees have been incurred and deducted, and we will not be liable to you for any expenses, damages or losses incurred as a result of the cancellation or postponement.
Photography, audio and video recording
The use of photographic, audio, video or other recording equipment at the event is strictly prohibited unless approved in writing in advance.
By attending the event, you acknowledge and agree that the event (or any part thereof) may be photographed or recorded by us, our collaborators or our partners. You agree that we, or any third party licensed by us, may use, distribute, broadcast or globally disseminate your image, name, voice and words in perpetuity on television, radio, film, newspapers, magazines and other media now available and to be developed in the future, both before, during and at any time after the event, and in any form, without the need for your approval or payment. This grant includes, but is not limited to, the right to edit the media, the right to use the media (alone or in conjunction with other information) and the right to allow others to use or distribute the media.
Your attendance at an event
You are responsible for informing us at the time of booking of any special access requirements at the event.
You are responsible for arranging your own insurance in connection with your attendance or exhibition at an event. We and our related companies are not liable for any injury or damage to any person or any real or personal property howsoever caused (except for death or personal injury resulting from our negligence or for any other liability which cannot be excluded or limited by law).
During the event, you will conduct yourself in an orderly manner and will not act in a way that causes offence, annoyance or inconvenience to other attendees. Attendees shall not prospect, promote, advertise or solicit business in a manner which, in our sole discretion, is deemed unacceptable. We reserve the right to eject from the Venue any attendee who, in our reasonable opinion, contravenes applicable laws or regulations or our or the Venue's policies and procedures, is likely to cause offence or annoyance or is otherwise inappropriate or fails to comply with these conditions.
Reimbursement and cancellation
Attendees, exhibitors or collaborators may cancel their ticket within 24 hours of purchase and receive a full refund of the amount paid, provided that the cancellation is made at least 20 days before the date of the event.
If cancellation is requested outside this period or less than 20 days before the event, no refund will be made. However, a change of ticket holder will be allowed at no additional cost, provided that the organisation is notified in writing at least 5 working days before the event.
The refund shall be made using the same method of payment used for the original purchase, and the applicant shall bear any transfer or currency exchange costs arising from the transaction.
Your ticket remains the property of the organisation and constitutes a revocable personal licence. The organisers reserve the right to withdraw the ticket and refuse admission to the event at any time, subject to reimbursement of the entry fee.
Resale prohibited
Tickets purchased are for your personal or business use only and may not be resold under any circumstances, including but not limited to use as part of any promotion or competition. This includes subsidised tickets.
Resale or transfer of your Ticket in any way that is not in accordance with the Terms will render the Ticket void and the Ticket Holder will not be allowed access to the Event. In the event of resale or attempted resale of Tickets (or any other breach of these Conditions), we reserve the right to cancel the relevant Tickets with immediate effect.
We reserve the right to cancel any Ticket purchase made by any person or body we reasonably believe to be associated with any reseller or Ticket broker.
Bracelets and cords
Bracelets and cords:
- Wear the official event wristband on your wrist; wear the official event lanyard containing your badge around your neck, and show it at all times when requested.
- Attendees are responsible for the proper maintenance of wristbands and lanyards. Replacement costs for lost or damaged wristbands will be borne by attendees; information on these costs is available upon request.
Visa requirements
It is your sole responsibility to take care of visa requirements. If you require an entry visa to attend or exhibit at the event, you must allow sufficient time for the visa application procedure.
In the event that you are not granted a visa, we are not obliged to reimburse you for the ticket, unless, in accordance with the legislation in force, you have the right to cancel the purchase of a ticket within 14 days of the day on which the distance selling contract was concluded.
Intellectual property rights
All intellectual property rights in the event, the content of the event and all materials distributed at or in connection with the event are owned by us, our related companies and/or event sponsors or speakers attending the event. You must not reproduce or permit anyone else to reproduce any trademarks or materials distributed by us or on our behalf at an event for any reason whatsoever, without our prior written permission.
Nothing in these Terms shall give you any legal right or benefit in any intellectual property rights owned or licensed by us or our related companies, or grant you any right or licence to any other intellectual property rights owned by us or our related companies. All such intellectual property rights shall remain the exclusive property of us and our related companies.
It is strictly prohibited for any company, organisation or person to attempt to host or organise any event in conjunction with, contiguous to or purporting to be related to an event or its affiliates without the prior permission and express co-operation of us. We reserve the right to take such action (legal or otherwise), including claims for damages, as we, in our sole discretion, deem appropriate in the circumstances.
Guarantees
To the fullest extent permitted by applicable law, we disclaim all warranties or conditions, whether express or implied, or any part thereof with respect to any aspect of an event or any related materials. You acknowledge and agree that, in agreeing to these Terms, you have not relied on any representation or warranty not expressly contained in these Terms and you agree that you shall have no remedy in respect of any misrepresentation that has not become part of these Terms.
Limitation of liability
You acknowledge and agree that the views expressed by speakers at or in connection with an event are their own and we accept no responsibility for advice given or views expressed at or in connection with an event.
Materials shared or distributed at, or in connection with, an event are intended for informational purposes only and should not be relied upon by you or others. We and our related companies provide no warranties or conditions as to the completeness or accuracy of the materials and accept no responsibility for any reliance you or any person may place on any aspect of the event and/or any information provided at the event.
To the extent permitted by applicable law:
- we and our related companies shall not be liable to you, whether in contract, tort (including negligence), misrepresentation, restitution or otherwise, for any loss of profits; loss of sales or business; loss of agreements or contracts; loss of anticipated savings; loss of revenue; loss of opportunity; loss of or damage to goodwill; loss of use or corruption of software, data or information; and/or similar or pure economic loss, or for any indirect or consequential loss, cost, damage, charge or expense arising in connection with the performance or intended performance of the Terms, even if we have been advised of the possibility of such loss, cost, damage, charge or expense in advance; and
- without prejudice to paragraph (a), our total liability in contract, tort (including negligence), misrepresentation, restitution or otherwise, arising in connection with the performance or intended performance of the Conditions, is limited to the total amount paid by you to us for your ticket to attend the event, after payment of any applicable handling fees or bank charges.
Nothing in these Terms is intended to exclude or limit liability for any fraudulent misrepresentation or act or in relation to any liability which cannot be excluded or limited under applicable law.
Indemnification
You agree to defend, indemnify and hold us, our related companies, affiliates, subsidiaries, joint ventures, third party service providers and our respective employees, contractors, agents, officers and directors harmless from and against all claims, liabilities, damages, losses, costs and expenses, including legal fees, arising out of or relating to any breach of the Terms by you or any other liability we incur as a result of your attendance at or participation in an event.
Force majeure
We will not be liable if an event is, in whole or in part, cancelled, rescheduled or postponed, or for any failure or delay in the performance of our obligations under these Terms, if such event is due to anything beyond our reasonable control (for example, natural disaster, flood, fire, acts of terrorism, war, labour strike, malicious damage due to extreme weather conditions, compliance with any law or governmental order, or mechanical, electronic or communications failure or degradation, health alarm, pandemic, epidemic or any emergency) or any other emergency, labour strike, malicious damage due to extreme weather conditions, compliance with any law or governmental order, or mechanical, electronic or communications failure or degradation, health scare, pandemic, epidemic or other emergency) or anything else which makes the performance of an event impracticable, illegal or impossible in whole or in part.
Applicable law and jurisdiction
The interpretation, formation and performance of the Terms and all non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of Spain, and all disputes between the parties arising out of or in any way connected with the subject matter of the Terms (whether contractual or non-contractual) shall be governed by the laws of Spain.
Each party submits to the exclusive jurisdiction of the Spanish courts in Malaga, Spain.
Nothing in the Conditions shall limit our right to commence enforcement proceedings in another jurisdiction or to seek injunctive or interim relief in the courts of another jurisdiction.
Final conditions
These Terms (including our privacy policy) contain the entire agreement and understanding between us in respect of all matters referred to herein and supersede any prior written or oral agreements between us in relation to such matters. You confirm that, in agreeing to these Terms, you have not relied on any representation not expressly made herein and you agree that you shall have no remedy in respect of any misrepresentation which has not become part of these Terms. However, nothing in these Terms is intended to exclude liability for any fraudulent misrepresentation or fraudulent act.
If a court with jurisdiction over these Terms finds any part of these Terms to be wholly or partly unenforceable, you and we agree that, to the extent possible, the court must modify the Terms to make that part enforceable while still serving their intended purpose. If the court is unable to do so, you and we agree that the court should disregard that unenforceable part and enforce the rest of these Terms.
If we do not insist that you comply with any of your obligations under these Terms or we do not act or delay in acting to exercise a right or remedy under these Terms, that does not mean that we have waived our rights or remedies against you and will not mean that you do not have to comply with your obligations.
These Terms are personal to you. You agree not to assign or transfer your rights or obligations under these Terms to any other person without our prior written consent. We may assign or transfer these Terms without your consent by notifying you.
You and we agree that no agency, partnership, joint venture or employment is created as a result of these Terms and you have no authority of any kind to bind us in any respect.
You agree that the only way to give us legal notice is at the address(es) indicated above.
To the extent permitted by law, the English version of the Terms is binding and any translation is for convenience only.
Under these Conditions:
- a reference to the Conditions includes all parts described herein and includes any modification or substitution thereof;
- the headings are for reference only and do not form part of the Conditions;
- a reference to a statute, code or other law includes regulations and other instruments thereunder, as well as consolidations, amendments, re-enactments or substitutions of any of them;
- the singular includes the plural, and vice versa; and
- includes", "including", "for example", "such as" and similar terms are not words of limitation.
If you are a consumer, nothing in these Terms excludes any of your applicable consumer or other non-waivable statutory rights.
2. Conditions for attendees
Tickets and prices
Here you will find details of ticket prices for attendees of an event. Ticket prices for an event are correct at the time of publication.
We reserve the right to change ticket prices at any time, but any changes will not affect tickets already purchased.
A valid ticket entitles you to enter the event in question as an attendee, but does not include any requirements relating to travel to or from the event or any accommodation costs incurred and we shall have no liability for any such costs or expenses.
Delivery
All entries must be assigned to an attendee, and all attendee details must be complete before attending the event. For the avoidance of doubt, this includes name, title, company name and other relevant information which may vary. Reassignment of tickets after this date is subject to the Conditions.
Discounts
We may from time to time offer certain discounted ticket promotions to encourage attendance at an event. We are under no obligation to offer any discount for any particular event and reserve the right to risk or withdraw a discount offer at any time at our sole discretion.
Prohibition of unauthorised promotion
Entry to the event does not grant the attendee the right to promote products, services or brands without prior written authorisation from the organisers.
Displaying logos, promotional messages or any brand elements on clothing, banners, physical media, flyers, giveaways, electronic devices or other media is strictly prohibited.
The use of the logo, visual identity or any distinctive element of Vitur Summit or any of its associated events is strictly prohibited without the express written authorisation of the organisation. This prohibition includes its use in the media, social networks, promotional materials, corporate documents, publications, websites, press releases or other digital or physical media.
Failure to comply with this rule may result in immediate expulsion from the event without refund.
Service animals
Please note that pets are not allowed, except for service animals.
Age restriction
All attendees under the age of 18 ("Youth Attendees"), must be accompanied by an adult or have written guardian permission to attend the event and all related events.
3. Conditions for exhibitors
Exhibitors
We offer space at events to Exhibitors who wish to occupy a place at the event and operate a stall where they can display certain goods or services to participants (an "Exhibitor") at agreed times, subject to these Conditions.
Exhibitors may only carry out their business activities in the space allocated to them and may not prospect, promote, advertise or solicit business in any other area of the venue without our prior written consent.
The Exhibitor is prohibited from subletting the Space without our express written consent. In the event that the Exhibitor is permitted to sublet the Space, the Exhibitor shall remain responsible for the Space and shall be liable for any breach of these terms by any party to whom the Space is sublet.
The Exhibitor may not prospect, promote, advertise or solicit business on behalf of unrelated Third Parties without our express written consent.
The exhibitor's operation at the event shall be carried out in full compliance with these conditions.
Location of exhibitors
We will agree with each Exhibitor the allocation of a specified space at the event, which may be set out in a separate contract.
We reserve the right, at our absolute discretion, to relocate exhibits and/or require the exhibitor to occupy an alternative exhibit within the specified location at the event where we deem it necessary in the best interests of the event or where necessary for safety, health and safety or other reasons.
Nothing in these Conditions creates or appears to create a landlord and tenant relationship between us and the Exhibitor, nor should these Conditions be construed as creating a transfer of an ownership interest to the Exhibitor or a greater interest in the Event in favour of the Exhibitor.
Maintenance standards
The Exhibitor shall maintain the interior, exterior, furniture and equipment installed at the Exhibitors in a clean, tidy, hygienic and good condition.
Waste
The Exhibitor is responsible for the disposal of all waste products and rubbish and for the removal of all rubbish generated by the Exhibitor. If necessary, the Exhibitor will provide litter bins for use at the event which the Exhibitor must remove from the venue at the end of each day. The Exhibitor is also responsible for the regular cleaning of the tables and floors in and around his exhibition area.
Access
We permit the Exhibitor to operate the Exhibition at such times as may be communicated to him from time to time. The Exhibitor shall ensure, to our satisfaction, that all exhibits and rubbish are completely dismantled and removed from the site on each day of the event. The Exhibitor shall not be entitled to allow access to the exhibition area to any person other than his own staff or any person doing business with the Exhibitor.
Health and safety
The Exhibitor selling food and beverages must ensure that he is registered with his local food safety and standards office and that he complies at all times with the relevant safety and compliance laws and regulations. The exhibitor must hold and display at his exhibition a valid licence proving his registration with his local food safety and standards office.
All cooking and heating equipment shall be safe and compliant. The exhibitor shall ensure that all external gas units are properly caged. Such units shall be kept away from public access. The exhibitor shall ensure that his exhibit is equipped with the appropriate number, size and type of charged fire extinguishers.
Safety instructions
The Exhibitor must observe and comply with, and ensure that his personnel employed at the Exhibitions observe and comply with, all instructions and directions given by or on behalf of us or the venue management, as well as our rules and regulations and those of the venue management, as communicated from time to time. The Exhibitor must not damage or allow its employees to damage the venue hosting the Event or the Exhibition or any part thereof. All Exhibitor's personnel on the premises must wear identification badges at all times and must not enter any restricted areas.
4. Terms of volunteering
Selection
You can apply to volunteer at an event.
There is no guarantee that applicants wishing to volunteer at the event will be selected and the selection of Volunteers is at our sole discretion.
Selected Volunteers must vouch for the truthfulness of all statements made in their volunteer application.
Without limiting their other obligations under these Terms, Volunteers are subject to the following rules governing their relationship with us:
- Volunteers will not receive any compensation for travel or accommodation related to the event;
- Volunteers who violate any of these Conditions, who behave in a manner likely to disrupt the event or any other attendee, volunteer, exhibitor and/or partner, who consume alcohol and/or illegal substances before or during their work, or who fail to report for an assigned shift, may be stripped of their credentials, denied access to the event and may be ejected from the event venue;
- Volunteers acknowledge that they may be photographed or videotaped in accordance with the section "Photography, audio and video recording"; and
- Volunteers who may handle confidential information undertake to treat such information in the strictest confidence and to respect the rules governing its use, as set out in the privacy policy.
Ticket refunds
If you have been selected to volunteer at an event but have already purchased a ticket, you will not be eligible for a refund or reimbursement under any circumstances.
5. Access and use of the website
Intellectual property of the website
All intellectual property rights of the content of these web pages, their graphic design and source codes are the exclusive property of VITUR. The exclusive exercise of the rights of exploitation of this property corresponds to this company.
Under no circumstances may the content of the website be used, reproduced, copied or transmitted in any way without the prior, written and explicit consent of VITUR. Likewise, all trade names, trademarks or distinctive signs of any kind contained on this website are protected by intellectual and industrial property.
VITUR owns the intellectual property rights, or has obtained the necessary authorisations or licences for their exploitation, of the domain name, trademarks and logos, the application, and other works and inventions related to the website and its contents.
VITUR, as the party responsible for the collection of the professional data published on the website, is the owner of the intellectual property rights of the corresponding database.
Users authorise VITUR to use the contents incorporated into the website for publication, distribution and public communication, free of charge, universally and without geographical or time limitation.
Users declare that they hold all rights, licences and permissions to publish published content on the website and exonerate VITUR from all liability.
Website content and links
VITUR is not responsible for the misuse of the contents of its web pages, being the sole responsibility of the person who accesses or uses them.
Nor do we assume any responsibility for the information contained in the websites of third parties which can be accessed by links from our websites.
Responsibility for the exchange of information
VITUR declines all responsibility derived from the exchange of information between users through its web pages, and shall not be held responsible in the event that the contents of the same disturb or offend minors in any way.
Liability for technical problems
VITUR shall not assume any liability that may arise from technical problems or failures in computer equipment, not attributable to the company, that occur during connection to the Internet, or damage that may be caused by third parties through unlawful interference beyond the control of VITUR.
Nor shall it be liable for any damages that the user may suffer as a result of errors, defects or omissions in the information we provide when it comes from outside sources.
Content update
VITUR reserves the right to update, modify or delete the information contained in its web pages, as well as their configuration or presentation, at any time, without prior notice and without assuming any type of responsibility.
